On the 6 Nov 2009 the Heatley Mere Management Situation is this....

Dear Peter

Your Form 288a has been safely received.

We have now completed the reversion sale of the final Sub Phase at this development.

Furthermore, we are ready to complete the Transfer of the Mere and other common parts in favour of the Management Company. However we have one more hurdle to overcome before completing this Transfer and hand over control of this company to the residents, namely drainage adoption. We cannot complete our drainage adoption Agreement with United Utilities under Section 104 of the Water Industry Act until we have completed a Deed of Grant with an adjacent landowner. This has made progress recently and we are hoping therefore that the matter will conclude in the near future.

I shall keep you advised as to progress.

YOUR ESTATE NEEDS YOU ! -- You may recall recent correspondence from Countryside Properties about the setting up of a management company to take over the running of our estate, in particular the appointment of agents to look after the common areas etc (currently Trinity Estates ). Three or four residents have put themselves forward as potential directors of this company, but there is still time to join them. We are looking for people in particular with business skills, e.g. legal, accounts, etc, but anyone with an interest in their local community would be welcome. Even if you do not wish to become a director, any help or expertise you can offer would be welcome.

If you wish to contribute some time for your community, please contact Peter Astbury as soon as possible.

We have 3 people willing to become directors of Heatley Mere Management Limited:

Mr W - (Quantity Surveyor -flats) . Mrs K - (Language teacher- house) ..Mrs L - (retired - flats)

I have indicated that I think we need 4 people for a quarum and balance so under slight protest & given the absence of anyone else stepping forward, Mr A (55 Chaise) will become the 4th director.

The 'lawyer-speak' delays pertaining to 'reversionary interest' in the e mails below are to do with ground rent transfer to Theowal (Consensus) , once this is done Angela Dowding & Countryside Properties will be ready to move on the director appointments & the transfer from Countryside (Trinity) to Heatley Mere Mangement Ltd (the residents - ie us)

If anyone wants to get involved or has a view on the direction this is going, then now is a good time to step forward.

Dear Peter

I apologise for the delay. As I have mentioned previously, the first hurdle we need to overcome is to transfer the reversionary interest in the remaining 8 plots at this development to the Consensus Business Group. Until now, Consensus have always used the same firm of solicitors in connection with reversion sales at Heatley Mere. However on this occasion they have decided to change solicitors. This means that the new solicitors now have to familiarise themselves with the paperwork. Furthermore there has been some discussion with Consensus over the price to be paid for this reversionary interest. I am hopeful however that we should be able to complete the sale of this final reversion interest by end July, following which we will put in place the Management Company Transfer and then arrange for handover of control to the residents.

I have spoken to Sue today (Mon 6 July 09)

Sue tells me that a Tracey Warren has some involvement in this process?

I understand that you are back at base on Tuesday 7th July 09 - please could you update me.
